1. Agreement to Terms

By accessing or using WashBot's services — including WashBot Chat, CleanSweep, and ShineBot (collectively, the "Services") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legal agreement between you ("Client," "you," or "your") and WashBot ("we," "us," or "our").

2. Description of Services

WashBot Chat: A website chat assistant custom-trained on your car wash business. It answers customer questions, promotes memberships, and operates 24/7 on your website.

CleanSweep: A competitive intelligence dashboard that analyzes publicly available data about competitor car washes in your market, including pricing, services, and ratings.

ShineBot: A review management service that monitors your Google Business Profile reviews, generates response drafts, sends alert notifications for low-rated reviews, and (when authorized) posts approved responses on your behalf.

3. Account and Access

To use our Services, you must provide accurate business information and maintain the security of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions and Billing

WashBot Services are offered on a month-to-month subscription basis. There are no long-term contracts. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.

Some Services include a one-time setup fee in addition to the monthly subscription. Setup fees are non-refundable once onboarding has begun.

All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. We will provide reasonable notice of any pricing changes before they take effect.

5. Cancellation and Refunds

You may cancel your subscription at any time by contacting us through our contact form. Upon cancellation, you will retain access to the Services through the end of your current billing period. No partial-month refunds will be issued.

After cancellation, your data will be retained for 90 days to allow for reactivation. After 90 days, your data may be permanently deleted upon request.

7. Google Business Profile Authorization

If you use ShineBot and authorize WashBot to access your Google Business Profile, you grant us permission to read your reviews, generate response drafts, and post approved responses on your behalf. You may revoke this authorization at any time through your Google Account permissions.

You remain solely responsible for the content of all responses posted to your Google Business Profile, even those generated or suggested by our Services. We recommend reviewing all draft responses before approving them for posting.

8. Intellectual Property

All WashBot platform technology, software, designs, and branding are the intellectual property of WashBot. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services for your business during the subscription period.

You retain full ownership of your business data, including conversation transcripts, review data, and any content you provide to us for service configuration.

9. Data and Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using our Services, you consent to the data practices described in the Privacy Policy.

10. Service Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, updates, or improvements that temporarily affect service availability. We will make reasonable efforts to notify you in advance of planned downtime.

11. Limitation of Liability

To the maximum extent permitted by law, WashBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid to WashBot in the three (3) months preceding the claim.

We provide the Services on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Indemnification

You agree to indemnify and hold harmless WashBot and its officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Texas.

14. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through a notice on our website or via the contact information associated with your account. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
